These Terms set out the basis on which we sell to you and on which you may use our website. They apply to every order placed with Loby.
About these Terms
Welcome to Loby. In these Terms, “we”, “us” and “our” mean Loch & Skye LTD, a company registered in Scotland under company number SC753199, trading as Loby. “You” means the person using our website or buying from us.
We operate this store and website, including all related information, content, features, tools, products and services, in order to provide you with a curated shopping experience (the “Services”). Loby is powered by Shopify, which enables us to provide the Services to you.
These Terms and Conditions, together with any policies referred to in them, describe your rights and responsibilities when you use the Services. They include important information about your legal rights and cover areas such as disclaimers and limits on our liability, so please read them carefully.
By visiting, interacting with or using our Services you agree to these Terms and to our Privacy Policy. If you do not agree to them, please do not use the Services.
Nothing in these Terms affects your statutory rights as a consumer. If anything here conflicts with those rights, your statutory rights take precedence.
Access and accounts
By agreeing to these Terms you confirm that you are old enough, under the law where you live, to enter into a contract with us, and that if anyone in your care uses the Services on a device you own or manage, they do so with your consent.
To use the Services — including browsing our store or buying from us — you may be asked to provide certain information, such as your email address and your billing, payment and delivery details. You confirm that the information you give us is correct, current and complete, and that you are entitled to provide it.
You are responsible for keeping your account details secure and for activity on your account. You may not transfer, sell, assign or license your account to anyone else.
Products
We make every effort to represent our products accurately. Please note that colours and finishes can look different on screen depending on your device and its settings, so the shade you see may not exactly match the product in your home.
Product descriptions may change at any time. We may discontinue a product, and we may limit the quantity of any product we offer to any person or place, on a case-by-case basis.
This does not reduce your legal right to receive goods that are as described, of satisfactory quality and fit for purpose.
Orders
When you place an order you are making an offer to buy. We may accept or decline an order at our discretion. Your order is accepted when we confirm acceptance to you, and we must receive and process your payment before an order is accepted.
Please check your order carefully before submitting it, as we may not be able to change or cancel it once it has been accepted. If we do not accept, change or cancel an order, we will try to contact you using the email address, billing address or phone number you gave us at the time.
Returns and exchanges are handled in line with our Returns & Refunds policy, and your legal right to cancel is set out there.
Our products are sold for your own personal or household use, and not for commercial resale.
Prices and payment
Prices, discounts and promotions may change at any time. The price that applies to your order is the price shown when you place it, and it is confirmed in your order confirmation email.
Prices are shown in pounds sterling. Delivery charges are shown separately, and the full amount payable — including any applicable taxes and delivery — is shown to you before you confirm your order.
Prices in our online store may differ from prices offered elsewhere. From time to time we may run promotions on separate terms; where those terms conflict with these Terms, the promotion terms apply to that promotion.
You agree to give us accurate and current payment and account information, and to keep it up to date so that we can complete your order and contact you if we need to. You confirm that you are authorised to use the payment method you provide.
Shipping and delivery
We deliver to the UK mainland only. Our current delivery options, prices and timescales are set out on our Shipping & Delivery page, which forms part of these Terms.
Delivery times are estimates. We are not responsible for delays caused by events outside our reasonable control, and we will let you know as soon as we can if a delay affects your order.
Risk of loss or damage in transit stays with us until the goods are delivered to you, or to someone you have nominated to receive them at the delivery address. If you arrange your own carrier, risk passes to you when we hand the goods to that carrier.

Returns, refunds and warranty
Our full policy, including how to start a return, is on our Returns & Refunds page.
You may return an item for any reason within 30 days. For change-of-mind returns you pay the cost of return postage, and items should be unused and in their original packaging.
If your order arrives damaged, faulty or incomplete, please tell us within 7 days so we can put it right quickly. This is a request to help us resolve things promptly, not a time limit on your legal rights — your statutory rights in respect of faulty or misdescribed goods are unaffected and last longer.
Refunds are processed once we have received and inspected the returned item, and are made to your original payment method. Your bank or payment provider typically takes a further 3–5 working days to show the funds.
Our products carry a 1 month commercial warranty from the date of delivery. This warranty is in addition to, and does not affect, your statutory rights as a consumer, which give you remedies for faulty goods well beyond that period.
Intellectual property
Our Services — including our trade marks, brand, product designs, text, images, graphics, video, audio, page layout and the selection and arrangement of all of it — are owned by Loby or our licensors and are protected by UK and international copyright, trade mark, design and other intellectual property laws.
We are a member of ACID (Anti Copying in Design). Membership supports us in protecting our original designs; it is not itself a patent, a registered design or any form of government certification.
You may use the Services for your own personal, non-commercial use. You must not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store or transmit any material from the Services without our prior written consent. Nothing in these Terms grants you any licence or right under any intellectual property belonging to Loby, Shopify or any third party. All rights not expressly granted are reserved.
The Loby name, logo, product names, designs and slogans are our trade marks and may not be used without our prior written permission. Shopify’s name, logo and marks belong to Shopify, and all other marks on the Services belong to their respective owners.
Third-party tools and links
You may be given access to tools provided by third parties which we neither monitor nor control. Those tools are provided “as is” and “as available”, without warranties of any kind and without endorsement by us, and you use them at your own risk. You should make sure you are familiar with, and happy with, the terms on which the relevant provider offers them.
The Services may also contain links to websites operated by third parties, including embedded third-party functionality. We are not responsible for the content or accuracy of third-party material, and if you leave our Services to visit them you do so at your own risk. Please read their terms and privacy policies. Questions or complaints about third-party products and services should be directed to that third party.
New features and tools we add in future form part of the Services and are covered by these Terms.
Shopify
Loby is powered by Shopify, which enables us to provide the Services to you. Any sale or purchase you make in our store is made directly with Loby.
By using the Services you acknowledge that Shopify is not responsible for any aspect of a sale between you and Loby, including any injury, damage or loss resulting from products or services purchased. You release Shopify and its affiliates from claims, damages and liabilities arising from your purchases and transactions with Loby, to the extent the law allows.
Privacy and cookies
All personal information we collect through the Services is handled in line with our Privacy Policy. Some personal information may also be subject to Shopify’s own privacy policy.
Because the Services are hosted by Shopify, Shopify collects and processes information about your use of the Services in order to provide and improve them. Information you submit may be transmitted to Shopify and to other providers, who may be located outside the country where you live, in order to provide the Services to you. Our Privacy Policy explains this, including the safeguards that apply to international transfers.
How we use cookies and similar technologies is explained in our Cookie Policy.
Feedback and reviews
If you send us ideas, suggestions, feedback, reviews or other content (“Feedback”), you grant us a worldwide, royalty-free licence to use, reproduce, publish, distribute and display that Feedback in order to operate, evaluate, improve and promote the Services and our products.
You confirm that the Feedback is yours to give, that you have disclosed any incentive or compensation you received for providing it, and that it complies with these Terms. We are not obliged to keep Feedback confidential, to pay for it, or to respond to it.
We may — but do not have to — edit or remove Feedback that we consider unlawful, offensive, defamatory, obscene or otherwise objectionable, or that infringes anyone’s rights.
Your Feedback must not infringe anyone else’s rights, must not be unlawful, abusive or obscene, and must not contain a virus or other harmful code. Please do not use a false email address or pretend to be someone else. You are responsible for the Feedback you submit and for its accuracy.
Errors and omissions
Occasionally information on the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, delivery charges, transit times or availability.
We may correct any error, inaccuracy or omission, and change or update information, at any time without prior notice. Where an error affects an order you have already placed — for example an obviously incorrect price — we will contact you before proceeding, and you may cancel and receive a full refund.
Prohibited uses
You may use the Services for lawful purposes only. You must not use them, directly or indirectly:
- for any unlawful or malicious purpose, or to breach any applicable law or regulation;
- to infringe our intellectual property rights or those of anyone else;
- to harass, abuse, insult, defame, intimidate or harm our staff or any other person;
- to transmit false or misleading information;
- to send or procure the sending of advertising or promotional material, including junk mail, chain letters or spam;
- to impersonate any other person or entity;
- to restrict or inhibit anyone else’s use of the Services, or in any way that may harm Loby, Shopify or other users, or expose them to liability.
You also agree not to upload or transmit viruses or other malicious code; reproduce, duplicate, copy, sell or resell any part of the Services; collect or track other people’s personal information; spam, phish, spider, crawl or scrape; or interfere with or circumvent the security features of the Services or any related website.
We may suspend, disable or terminate your account if we reasonably determine that you have breached this section.
Termination
We may end this agreement or your access to the Services at any time. Where we do so, we will act reasonably and, unless the circumstances make it inappropriate, give you notice. You remain liable for amounts due up to the date of termination.
Termination does not affect any order we have already accepted, or your rights in relation to it.
The following sections continue to apply after termination: Intellectual property, Feedback and reviews, Termination, Disclaimers and liability, Indemnity, Severability, Waiver and entire agreement, Assignment, Governing law, Privacy and cookies, and any other provision that by its nature should survive.
Disclaimers and liability
Information on the Services is provided for general information only. We do not warrant that it is accurate, complete or useful, and any reliance you place on it is at your own risk.
The Services themselves are provided “as is” and “as available”. We do not guarantee that they will be uninterrupted, timely, secure or error-free.
None of this affects the legal rights you have when you buy goods from us. Goods we supply must be as described, of satisfactory quality and fit for purpose, and we do not exclude or limit those rights in any way.
We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, or for business losses — we supply our products for domestic and private use, and we have no liability for loss of profit, loss of business, business interruption or loss of business opportunity.
We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your statutory rights in relation to goods, and for any other liability that cannot lawfully be limited.
Indemnity
If you use the Services in breach of these Terms or in breach of the law, and a third party brings a claim against us as a result, you agree to reimburse us for the losses, damages, liabilities and reasonable legal fees we incur in connection with that claim.
This applies only to the extent the claim arises from your own breach or unlawful act. We will tell you about any such claim, and we will not settle it on terms that impose an obligation on you without your agreement, which you will not withhold unreasonably. Nothing in this section applies to anything you do as a consumer acting reasonably and in good faith.
Severability
If any provision of these Terms is found to be unlawful, void or unenforceable, it will still be enforceable to the fullest extent the law allows, and the unenforceable part will be treated as removed. The remaining provisions continue in full force.
Waiver and entire agreement
If we do not exercise or enforce a right or provision of these Terms, that is not a waiver of it.
These Terms, together with any policies we publish on this website, form the entire agreement between you and us about your use of the Services, and replace any earlier agreements or versions.
Any ambiguity in these Terms will not be interpreted against whichever of us drafted them.
Assignment
You may not transfer or assign these Terms, or your rights or obligations under them, without our prior written consent, and any attempt to do so is void.
We may transfer or assign these Terms and our rights and obligations under them. If we do, we will tell you, and it will not affect your rights under these Terms or under the law.
Governing law
These Terms, and any dispute or claim arising out of them or your use of the Services, are governed by the law of Scotland.
You and we both agree that the courts of Scotland have jurisdiction. If you are a consumer, this does not take away rights you have under the law of the part of the United Kingdom where you live — if you live in England, Wales or Northern Ireland you may bring proceedings in your local courts, and you may rely on the consumer protection rules that apply there.

We may update, change or replace part of these Terms by posting an updated version here. We will tell you about any material change in line with applicable law, and the change will take effect on the date given in that notice. Changes do not apply retrospectively to an order we have already accepted.
